Read this release carefully
This release concerns use of the free Golf Tournaments app operated by Matthew Carbert. It does not replace a sporting organization's participation, medical, or event waivers. The app is not an emergency service and must not be relied on for safety-critical communication.
Risks you acknowledge
You acknowledge that the app may be unavailable, inaccurate, changed, or discontinued, and that information may be lost, corrupted, deleted, accessed without authorization, or disclosed in a privacy breach. Tournaments and associated data may be permanently purged at the developer's discretion, subject to applicable law. No backup, retention, recovery, or support service is guaranteed. Keep your own independent records and confirm important schedules and communications with your tournament organizers.
Limited release
To the maximum extent permitted by applicable law, you release Matthew Carbert from lawfully waivable claims and losses resulting from ordinary use of, inability to use, interruption of, data loss in, security incidents involving, or permitted deletion of data from the free app, including indirect and consequential losses. You accept the service limitations set out in the Terms of Use.
Rights and duties that remain
This release does not exclude liability or waive rights that cannot legally be excluded or waived. It does not remove applicable statutory privacy, safeguard, breach-reporting, consumer-protection, or other mandatory obligations, and does not purport to excuse fraud or intentional wrongdoing. If any part is unenforceable, applicable law determines the remaining rights and obligations.
Authority to accept
By selecting Accept, you affirm that you are at least 18 and have lawful authority to consent to app use and the sharing of information for any minors you add. A child added to a roster is not treated as personally accepting this release. Any acknowledgement on behalf of a minor is limited to the authority the law allows.
